Property owners in Missouri recently received a $130 million jury verdict in a class action lawsuit that included vital testimony from Greenfield Advisors Chairman and Co-Managing Director Dr. John A. Kilpatrick. Attorneys for the property owners successfully argued that Sho-Me Power Electric Cooperative was trespassing when it ran fiber optic cable on more than 3,500 properties without paying the property owners.
The verdict, which could end up being one of the largest awarded by a jury in the U.S. this year, followed the testimony of Dr. Kilpatrick, a licensed real estate appraiser in all 50 states and Washington, DC. The real estate valuation expert testified to the value of the land being used in accordance with trespass damages, and the jury agreed with his assessment.
It was not the first time Dr. Kilpatrick successfully argued the value of the property in the case. In 2015, a jury awarded the claimants $79 million in damages based on Dr. Kilpatrick’s testimony. However, the verdict was appealed, and an appellate court ruled that the damages phase of the case had to be retried.
